Incorrect claims: Nomige and Astrid Coppens vindicated in fight against Test Achats

The acting president of the Dutch-speaking Commercial Court of Brussels has ruled that Test Achats CV and Test Achats VZW based their public communication on the sun protection provided by Nomige & Astrid Coppens on a test basis that, in light of the methodological objections formulated and substantiated in advance by Nomige BV, was insufficiently adequate and too methodologically vulnerable.

By nevertheless communicating publicly as if it were established that the product in question offered significantly lower protection than claimed, without adequately, loyally and transparently presenting Nomige BV's serious counter-arguments, they violated their duty of care. The contested publications were found to be unlawful, and their further dissemination was ordered to cease. This publication must take place within 48 hours of service of the judgment, subject to a penalty of EUR 1,000 per day of delay, up to a maximum of EUR 50,000.
